Order Cancellation
Orders are binding, they can only be cancelled if the goods have not yet been dispatched, necessarily from your "My Orders" section.
Due to the high stock rotation, item availability on 440hz.co.uk is constantly monitored and automatically synchronised at regular intervals.
In the event of an order placed on out-of-stock items during a synchronisation, an item may appear as available even though it has actually just been sold: in this case the customer will be promptly updated.
For orders already processed, the customer will have to exercise the Right of Withdrawal.
Attention: the times indicated for delivery terms are indicative and are in no way binding for the Luciano Andrea snc company.
It is possible to check the shipment status on-line by accessing the site with your e-mail and password and going to the My orders section.
Warranty on articles
NEW articles purchased on 440hz.it are covered by an Italian warranty in accordance with Italian Legislative Decree 206/2005 (consumer code).
WARRANTY shall mean repair or replacement free of charge of components or parts of the equipment recognised by their manufacturers as defective in manufacture or material. The guarantee does not cover accidental damage or damage resulting from loss, non-use of the article, damage caused by loss of information stored by the customer in any form whatsoever. Furthermore, no liability is accepted for any damage which may, directly or indirectly, be caused to persons, things or animals as a result of failure to observe the prescriptions set out in the relevant operating manuals and concerning, in particular, warnings on the INSTALLATION, USE AND MAINTENANCE OF THE APPLIANCE.
The WARRANTY is granted to those purchasers who present the original purchase invoice together with the article whose repair is being requested.
Warranty terms
The guarantee is valid for the period indicated, starting from the date of invoice on all parts of the article not subject to wear and tear due to malfunctions attributable to factory defects.
The guarantee DOES NOT APPLY to damage caused by neglect, incorrect use and installation NOT IN ACCORDANCE with the warnings and instructions in the instruction or installation manual, misuse, mistreatment, deterioration, lightning, atmospheric phenomena, overvoltages and overcurrents, insufficient or irregular power supply, adaptation or modification, nor damage caused by incorrect use or in CONTRADITION WITH THE TECHNICAL AND/OR SAFETY MEASURES REQUIRED IN THE COUNTRY IN WHICH THE APPLIANCE IS USED.
If, during the warranty period, one or more parts are replaced for repair with part(s) not authorised by the relevant manufacturer(s), or which do not comply with the safety and quality measures appropriate for the same, or if the repair is carried out by UNAUTHORISED personnel, the purchaser loses the right to repair.
EXCLUDED from this guarantee are consumable parts considered subject to normal wear and tear or wear and tear such as: strings, batteries, valves, speakers, etc.
Right of withdrawal
Purchases on our site are subject to the regulations of Legislative Decree no. 206/2005 (Consumer Code), dictated on the subject of distance contracts, in cases where the delivery of the goods takes place at the domicile or place indicated by the purchaser, as such purchases are made outside of business premises.
The importance of the aforementioned legislation lies in the provision of the purchaser's right of withdrawal.
What does it consist of?
The consumer has the right to withdraw from the contract within the conventional term of 15 days from receipt of the goods, by returning the goods subject to withdrawal to the seller. It should be noted that in the hypothesis of premium operations (the so-called promotions), in which the purchase of an asset is combined with another asset that is sold at a derisory price or even given as a gift, the right of withdrawal will be legitimately exercised with the return of both goods purchased, given the constraint of the ancillary nature of the asset in promotion with respect to the first.
Can I exercise the right of withdrawal?
The legislation provides that the right of withdrawal may only be exercised by natural persons (consumers) acting for purposes that can be considered unrelated to their commercial activity. The right of withdrawal, therefore, cannot be exercised by legal persons and natural persons acting for purposes related to a commercial activity. Also excluded from the right of withdrawal are purchases made by resellers or by persons who in any capacity purchase for resale to third parties.
What does it include?
440hz.it will refund all payments relating to the order subject to withdrawal received by the consumer, possibly including delivery charges net of additional costs. The consumer will still bear the direct cost of returning the goods.
440hz.it may withhold the refund until it has received the goods or until the consumer has provided proof that they have been returned, whichever is sooner.
The consumer must return the goods without undue delay and in any event within 14 days from the date on which he communicated his decision to withdraw from the contract. The deadline will be met if the consumer returns the goods before the expiry of the 14-day period.
However, the consumer shall be liable for any diminution in the value of the goods resulting from any handling other than that necessary to establish their nature, characteristics and functioning.
What does it exclude?
The right of withdrawal does NOT apply to:
- Audiovisual items or computer software in download or delivered sealed
- Custom-made items made to the customer's personal requirements (e.g. Custom Flight Cases, Custom Order Tools)
- Sealed goods which, for reasons of health protection or hygiene, are not suitable for return (e.g. mouthpieces for wind instruments)
- Valves / Vacuum Tubes if installed, as they are subject to wear and tear and/or the feet may be marked
- Pickups if installed: welds and cables cut pre/post installation affect their condition by being no longer new
- Speakers if installed, as bolts may mark the chassis and ditto contact points may be marked
- Used consumables (drumsticks, picks, strings and the like)
- Products not in stock and ordered specifically for the customer
How can the right of withdrawal be exercised?
You must have the following components, documents and data available
original packaging, unworn and undamaged in all its parts
original invoice
in the case of partial withdrawal, in addition to the purchase invoice, the article number(s)
At this point you may contact 440hz.co.uk Customer Service, who will inform you of the procedure to be adopted to open the withdrawal file, and at the same time give you authorisation to return the components.
The procedure is summarised below:
Sending a communication containing a declaration that you wish to exercise the right of withdrawal, indicating all the required data: order number, invoice number, the e-mail address with which you registered, which items are to be returned (identifying them with the item code).
How is 'return' shipment to 440hz.co.uk carried out?
1. After activating the withdrawal procedure, you must place the original wrapping containing the goods in a suitable package, so as to safeguard the original wrappings of the items from any damage, writing or alteration. 440hz.it reserves the right to refuse the goods received if the above procedure is not followed.
2. The goods must be sent, at your own expense, within 10 days from the return authorisation communicated by our after-sales department (art. 67 D. Lgs. 206/2005), to the following address:

Please note: we recommend that you use a courier or other suitable means to allow the shipment to be traced. It is understood that 440hz.it will not proceed with the refund of the goods subject to withdrawal if it does not receive the relevant delivery.
How long does the refund take?
Within 14 days of receipt of the goods, 440hz.it will credit the Customer.
Warnings
440hz.it reserves the right not to accept shipments of components or items that:
• do not contain original packaging, accessories and manuals
• have been made without activating the request for service to 440hz.it Customer Service
• are shipped without following the shipment instructions provided by 440hz.it Customer Service.
In such cases, the transport costs inherent to both shipment and return will be borne by the customer.
